Broker-Lawyer Committee recommends adoption of three real estate forms and withdraws other proposals

The Broker-Lawyer Committee (BLC) convened on October 10 to welcome new members, review public feedback on recent proposals, and decide the status of several form changes under consideration.

The committee, which includes six attorneys appointed by the State Bar of Texas, six members appointed by the Texas Real Estate Commission (TREC), and one public member appointed by the Governor, introduced new appointees at the meeting. The new members are Kandi Luensmann as a broker member, Kristen Porter as an attorney member, and Kenneth Vall as an attorney member. Ron Walker, who serves as Co-Chair and Broker Member, was reappointed for another term.

During the meeting, the BLC recommended that TREC adopt three forms at its upcoming November meeting. These include updated temporary residential lease forms and a flood plain notice intended for use with leases. The forms were initially proposed at the August meeting.

The changes to the temporary lease forms follow Senate Bill 2349, which takes effect September 1, 2025. This legislation exempts temporary residential leases and short-term leases from requirements to provide landlords with flooding-related notices. In response, TREC has revised its Landlord’s Floodplain and Flood Notice as well as both Buyer’s Temporary Residential Lease and Seller’s Temporary Residential Lease agreements.

After considering public comments and further discussion about other potential contract changes, the committee decided to withdraw several additional proposals from immediate consideration. These included updates to Paragraph 12 of contracts, page 10 disclosures, groundwater and surface water rights disclosures, and new disclosures related to conservation easements and windstorm or other insurance matters. The committee intends to revisit these topics at its next scheduled meeting in January 2026.
