Governor Abbott orders stricter oversight on vape shops selling hemp products

Governor Greg Abbott has instructed the Texas Department of Public Safety (DPS) to intensify enforcement against vape and smoke shops that do not comply with state laws and regulations.

“Texas will protect children from dangerous hemp products,” said Governor Abbott. “Today, I directed the Texas Department of Public Safety to increase surveillance and enforcement of any vape and smoke shop violating Texas law. Texas will prioritize protecting our children.”

Following this directive, DPS’ Criminal Investigations Division (CID) will focus on identifying shops of concern and collaborate with other agencies at various levels to inspect these businesses for legal violations. CID Special Agents are set to use information from inspections for undercover operations aimed at uncovering unlawful activities, which may lead to further criminal investigations.

The DPS Crime Lab is tasked with testing any seized products resulting from these efforts. CID Special Agents will also pursue charges against employees and owners found in violation of state law. DPS plans to work closely with federal and local law enforcement partners throughout these investigations.

Last month, Governor Abbott issued an executive order instructing the Texas Department of State Health Services, the Texas Alcoholic Beverage Commission, and DPS to take immediate measures to protect children in Texas from hemp-derived products while ensuring compliance with federal law and upholding the rights of responsible adults.
